Factors for Determining Child Support
In Michigan, a formula manual and booklet clearly explains the child support guidelines used by the courts. Although there are occasional deviations from the formula, it is primarily based upon a number of enumerated factors, including:
- Incomes of parents, both employment and other available income
- Tax considerations
- Parenting time schedule (allocation)
- Childcare costs
- Special needs of children may be considered
While the child support formula is presumptive (quite rigid), it may be possible for the judge to deviate from it so long as it is part of an agreed-upon settlement involving property or other obligations. Exceptions may also be possible where one or both parties have incomes far above those the formula is based upon. However, even if both parties agree on a change, the final decision will be made by the court.
