Changing Lawyers

It is important to have confidence in your lawyer. He or she may be one of the best, but if you feel he or she is not doing a proper job, ask for an appointment to discuss your concerns. Often dissatisfaction is caused by a simple lack of communication. If you are unable to resolve your doubts or regain confidence in your lawyer, there is nothing improper about changing lawyers. But do so with caution. In many cases, your frustrations will be due to circumstances completely beyond your lawyer's control. Because of crowded court dockets, the time from the beginning of your case until the trial may be long. Often the opposition may legally aggravate the delay. While you wait, your problems may seem magnified. Be certain you are changing lawyers for good reason.

It is important to have good rapport with your lawyer. You have a right to have your questions answered. It is a good idea to put your questions in writing before meeting with the lawyer so that you will not forget points you want addressed. You also have a right, upon request, to see and receive copies of all papers in your file, except for the lawyer's own notes.

Before you change lawyers, it is important to agree what fees, if any, are due for past services and when they must be paid. Once this has been done, your new lawyer must file a substitution of attorney form with the court. Prior to discharging your old lawyer, make sure the new lawyer will take your case and reach an understanding, preferably in writing, with your new lawyer concerning fees and costs.
